General Terms and Conditions of Sale (GTCS) – SUMO CYCLEWORKS
1. Definitions
- GTU: General Terms of Use of the website, having full contractual value between SUMO CYCLEWORKS and the Client.
- GTCS: These General Terms and Conditions of Sale, accepted by the Client before any Order.
- Client: Any natural person of legal age or legal entity who has placed an Order on the website www.sumocycleworks.com.
- Order: Any purchase of a Product made by the Client on the website www.sumocycleworks.com.
- Product: Any good offered for sale by SUMO CYCLEWORKS via its website.
The purpose of these GTCS is to define the rights and obligations applicable to the sale of Products between SUMO CYCLEWORKS and the Client.
The validation of the Order by the Client implies unreserved acceptance of these GTCS.
The Order process complies with the "double click" principle (shopping cart + confirmation), which constitutes an electronic signature in accordance with Article 1367 of the Civil Code.
2. Orders
Any Order placed on the website constitutes a firm and definitive acceptance by the Client.
SUMO CYCLEWORKS reserves the right to cancel or refuse any Order in case of an existing dispute with the Client, payment issues, or unavailability of the Product.
3. Price
The prices indicated on the website are expressed in euros, all taxes included (TTC).
Delivery costs are indicated to the Client before final validation of the Order.
4. Payment
Orders are paid online via the secure payment methods offered on the website.
The Order is considered accepted only after payment confirmation.
5. Delivery
- Product delivery occurs only after full payment has been received.
- Products are delivered to the delivery address indicated by the Client during the Order or to a chosen relay point.
- Delivery times are indicative. Any delay does not constitute a reason for canceling the Order.
- In case of delivery outside the European Union, the Client is responsible for any applicable taxes, customs duties, or import fees.
Transfer of risks
The risks of loss or damage to the Products are transferred to the Client upon receipt. It is the Client's responsibility to check the condition of the package and to make any necessary reservations with the carrier in case of an anomaly.
6. Right of withdrawal
In accordance with Articles L.221-18 et seq. of the Consumer Code, the Client has a period of 14 calendar days from receipt of the Product to exercise their right of withdrawal.
- Return costs are the responsibility of the Client.
- The Product must be returned in perfect condition, complete, unused, in its original packaging.
- Any incomplete, damaged, or used Product will not be accepted for return or refund.
- SUMO CYCLEWORKS will proceed with the refund within 14 days from the notification of withdrawal, subject to receipt or proof of shipment of the Product.
- The refund will be made via the payment method used during the purchase.
Products excluded from the right of withdrawal
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to Products that are:
- Customized or tailor-made,
- Cannot be returned for reasons of hygiene or health protection if they have been unsealed.
7. Legal guarantees
SUMO CYCLEWORKS is bound by the legal guarantees:
- Legal guarantee of conformity (Articles L.217-3 to L.217-17 of the Consumer Code): valid for 2 years from the delivery of the Product. The Client may request the repair or replacement of the non-conforming Product, free of charge.
- Guarantee against hidden defects (Articles 1641 to 1649 of the Civil Code): applicable within 2 years from the discovery of the defect. The Client can choose between canceling the sale or a reduction in price.

9. Consumer mediation
In accordance with Article L.612-1 of the Consumer Code, any consumer has the right to free recourse to a consumer mediator in the event of a dispute.
10. Personal data
As part of the Order, SUMO CYCLEWORKS collects and processes personal data necessary for managing purchases, deliveries, and communications.
- Purposes: contract execution, customer relationship monitoring, commercial prospecting (if consent given).
- Rights: access, rectification, opposition, limitation, portability, erasure.

- Complaint: The Client may contact the CNIL (www.cnil.fr).
- Retention period: the time necessary for the execution of the Order and legal obligations (invoicing, disputes).
11. Intellectual property
All elements of the website (texts, images, graphics, logos, videos, icons, sounds, software) are protected by intellectual property rights and remain the exclusive property of SUMO CYCLEWORKS or its partners.
Any reproduction, representation, adaptation, or exploitation is prohibited without prior written authorization.
12. Force majeure
SUMO CYCLEWORKS cannot be held responsible for the non-performance or delayed performance of its obligations resulting from a case of force majeure as defined by French jurisprudence (strike, natural disaster, health crisis, supply disruption, etc.).
13. Applicable law – Competent jurisdiction
These GTCS are governed by French law.
Any dispute will be submitted to the competent courts within the jurisdiction of SUMO CYCLEWORKS' registered office.
